espanolLa primera parte del estudio concreta los conceptos de investigacion cientifica, en salud o biomedica, asi como el de “lineas” o “areas” de investigacion. Asimismo, se examina y determina lo que son los “datos relacionados con la salud” y especialmente se tiene en cuenta su incesante expansion, variada procedencia y tipologia y los efectos juridicos que ello implica. Se trata de los presupuestos basicos del nuevo regimen de proteccion de datos en la investigacion europea y espanola. En la segunda parte se analiza el alcance de esta nueva regulacion y su compleja interactuacion con toda la legislacion (sectorial e incompleta) de la investigacion medica. Se trata de una situacion laberintica juridicamente que se intenta aclarar. Para ello, se concreta el margen de actuacion que el RGPD ha conferido al legislador nacional y se afirma que la LO 3/2018 supone un estatuto general de la proteccion de datos de la investigacion biomedica que se proyecta sobre la legislacion sectorial y en sintonia con ella. Se apuntan elementos del futuro desarrollo legal y tambien el papel de reglamentos presentes y futuros. EnglishThe first part concretizes the concepts of scientific research, in health or biomedicine, as well as that of “lines” or “areas” of research. It also defines “health-related data”, its incessant expansion, its varied sources and typology and the legal effects that this implies. These concepts are the basic assumptions of the new data protection in research in European and Spanish law. The second part examines the scope of this new legal regime and its very complex interaction with all the sectoral and incomplete legislation on medical research. It is a labyrinthine situation, and our proposals are made to clarify. It is described and the scope of action that the GDPR has conferred on the national legislator is specified. It is proposed that LO 3/2018 provides a general statute for the protection of biomedical research data that is projected onto and in line with sectoral legislation. Elements of the future legal development are pointed out and also the role of present and future regulations.
