The intent constitutes a figure of difficult determination within criminal law, especially if it is intended to assess the intention of an individual at the time of committing a crime. In this context, the objective of the present manuscript is focused on gathering information about possible fraud, reckless driving and if this is contemplated within Ecuadorian legislation. For this it was necessary to go to secondary information sources such as books, codes, laws, articles, among others, to determine or not their application within the national context. With this background, it can be concluded that the study reveals the shortcomings within the country's legal framework, both with the Organic Law on Land Transport and Road Safety, whose last modification corresponds to 2014 and the Organic Comprehensive Criminal Code (2014). In neither of these two regulations is there an article that punishes reckless driving based on possible fraud.
