The increase of Venezuelan migration to other countries in the region, such as Brazil, leads to reflections on the use of the legal framework on the free movement of workers from the Southern Common Market (by its Spanish acronyms MERCOSUR). On review of the Venezuelan accession to MERCOSUR and the relevant migration norms, the conclusión could be that there was a delay in implementing MERCOSUR´s norms. This, together with the suspension of Venezuela as a Member State and, resulted in the weakining of Venezuelan inmigrants’ protection. In Brazil, after the enforcement of the new Immigration Law, there was a Federal Supreme Court decision about the situation of Venezuelans. The Court has decided to keep the border between the two countries open, in order to guarantee humanitarian activities for Venezuelan inmigrants.
