Entre la lex specialis y la metodología pick-and-choose: aproximaciones al derecho internacional humanitario en la jurisprudencia de la Corte Interamericana de Derechos Humanos
Through its jurisprudence, the Inter-American Court of Human Rights (IA Court HR) decides on the interaction between International Human Rights Law (IACHR) and International Humanitarian Law (IHL). This article demonstrates that the Inter-American Court of Human Rights has used IHL not only to interpret inter-American human rights instruments, but also to approximate the direct use of humanitarian norms, which creates a gray area between the interpretation and application of this area of Law. In doing so, the Court uses the lex specialis criterion if the IHL rule is the most specialized in the case; and selectively uses IHL specially to expand the content of human rights, but not necessarily to rule out possible violations of these, resulting in a sort of pick and choose methodology.
