The objective of the article is to demonstrate the way in which modernity and its crisis have taken place in the Latin American context and how a solution to its conflicts tries to be given with an alternative of comprehensive cure through the establishment of a social state based on the rule of law which recreates the sociological image of creative chaos.The methodology implemented was deductive and the dynamics of modernity, modernization and modernism and its crisis in Europe and the West countries and then in Latin America is described from it to finally present a proposition of a solution to the onslaughts of the time of the social state based on the rule of law which is, at the same time, the proposition to cure the controversies of political modernism expressed in the image of the rule of law
