Abstract On 14 December 2017, the 16th Assembly of States Parties ( ASP ) to the Rome Statute of the International Criminal Court adopted a resolution concerning the topic “Activation of the jurisdiction of the Court over the crime of aggression”. It is to be welcomed that this decision was taken by consensus, given that over the last year a serious disagreement had arisen among the States Parties to the Rome Statute with regard to the process of activation and its effects on the States that have not yet ratified or accepted the 2010 Kampala Amendments on the crime of aggression. The purpose of this article is to examine the process that led to the adoption of the activation resolution and to discuss how the said difference of views was overcome, on the eve of the 16th ASP .
