The Sentence which is the subject of this commentary annuls permits that had been awarded to the Fundación Instituto de Inmunología de Colombia (Colombian Institute of Immunology Foundation, FIDIC) to capture primates in the Colombian Amazon, for the purpose of using the primates in research to obtain a malaria vaccine. The Consejo de Estado Colombiano (Council of the State of Colombia, CEC) in this case resolves the appeal lodged against the Sentence from May 2012, proffered by the Administrative Court of Cundinamarca. The author comments on the most relevant aspects of the cited sentence which, in addition to resolving the case, includes some very important considerations with regards to the treatment and use of animals by humans, causing the CEC to position itself in favor of recognizing rights for non-human animals.
