The article addresses what is the competence and scope of military criminal jurisdiction in Colombia as a State Party to the American Convention on Human Rights, and the general objective of identifying the citation niches that the Inter-American Court of Human Rights has established in relation to the question under study. The result is achieved through the development of basic, descriptive, deductive research and through the creation of a jurisprudential line, obtaining: that military jurisdiction has a restrictive and exceptional scope, and that its jurisdiction is limited only in judging active military personnel by the commission of crimes or misdemeanors that by their very nature offend against legal property of the military order.
