espanolRESUMEN: La preocupacion frente a la violencia sexual en donde las victimas son ninos ha sido priorizada en el derecho penal, sin que esto contribuya a la satisfaccion de los derechos de las victimas y a la disminucion de la delincuencia. En este trabajo, en primer lugar, se analiza el populismo punitivo en los casos de violencia sexual, realidad que impide la reparacion efectiva de los derechos vulnerados; en segundo lugar, se describen a partir de la jurisprudencia de la Corte Constitucional, la Corte Suprema de Justicia y el Consejo de Estado, argumentos que pueden tener un claro efecto en la reparacion. Finalmente, son presentadas las exigencias y limitaciones de la justicia restaurativa en los casos de violencia sexual. EnglishABSTRACT: The concern confronting sexual violence where the victims are children it has been prioritized in criminal law, nevertheless, it has not contributed to the fulfillment of the victims' rights or the reduction of crime. On sexual violence issues, in first place, punitive populism is analyzed in cases of sexual violence, a situation which prevents of the rights violated; in second place, it is established in the framework of jurisprudence, the contentions and the solutions proposed by the Constitutional Court , the Supreme Court of Justice and the Council of the State which may have a clear effect in the recognition of and reparation of the rights Finally, the requirements and constraints of restorative justice in the cases of the sexual violence.
