Florelia Vallejo Trujillo in the country.Notably, the lack of clarity of the Decree Nº 1320 of 1998, which regulates the consultation process for the exploitation of natural resources within the collective territories, has been identified as the primary cause for the little accomplishment of consultations in the Colombian territory.Nonetheless, this article argues that the judgments issued by the Colombian Constitutional Court on the matter, develop not only the elements of prior consultation but also establish the general rules for its proper application.To that end, the jurisprudential lines of the regulatory framework for conducting consultation processes are presented.
