El presente artículo trata de analizar la aplicación de la denominada Teoría del Conocimiento Efectivo a la hora de determinar la responsabilidad de los Prestadores de Servicios de Intermediación (ISP), centrado fundamentalmente en dos tipos de prestadores: aquellos que prestan un servicio de alojamiento o almacenamiento de contenidos, y los que prestan un servicio de búsqueda y enlace a contenidos ajenos. Partiendo del hecho de que la actividad de estos prestadores es un instrumento clave para el desarrollo y la evolución de Internet, debe determinarse que ocurre en el supuesto de que los contenidos alojados o los enlaces realizados lesionen bienes y/o derechos de terceros, para lo cual se procede a analizar la normativa aplicable a este tipo de prestadores, la interpretación y aplicación realizada de la misma por los tribunales españoles y de la Unión Europea en casos concretos, y ya anticipa postura contraria a esta interpretación en determinados supuestos que considera incompatible con las reglas exigibles en el ámbito de la seguridad jurídica.Palabras Clave: ISP, Conocimiento Efectivo, instrumentos de búsqueda. This article attempts to analyze the application of the so-called theory of knowledge Effective on determining the liability of Intermediary Service Providers (ISP), focusing mainly on two types of providers, on the one hand those who provide a service storage or hosting content, and on the other those who provide a service search and link to external contents.
