This article approaches the legal aspects of breaking of human rights, decurrent of "Slaughter of the Carandiru", next to the Interamerian Commission of Human Rights, with mention of the happened one, its procedural proceeding and current period of training.The Slaughter of the Carandiru happened in day 02 of October of 1992, after a rebellion initiated for the prisoners in pavilion 9 of the House of Detention of the Carandiru in São Paulo, when the Military Policy invaded the place and the balance had been 111 died prisoners, episode where the Brazilian State committed serious breakings to the recognized human rights for the American Convention of Human Rights, approved for the Organization of American States -OEA, in 1969, for the Pact of San Jose of the Costa Rica, of which Brazil is signatory.As much the event in itself how much its unfoldings, they place in question the consolidation of the Democratic State of Brazilian Right, in view of the breaking of most basic of the individual rights, assured for the Federal Constitution of 1988: the right to the life.
