The work contract is an executive title? The answer to this question is the object of this article, and directly implies consequences related to the effectiveness of the social rights. In the labor right always it has been accepted, without any discussion, that before the breach of the obligations of the employer, as the payment of the wage, the worker necessarily must go to the process of knowledge through ordinary procedure so that the profierce judge a sentence condemnation that serves as executive title to initiate the executive process. And thus it has been always. To present/display a demand to initiate a labor executive process with the work contract as executive title means more than the negation of the judge to free the executive order, the consideration of almost ignorant in the labor litigation. Nevertheless, they are mistaken who think thus.
