This paper analyses the evolution of the improper joint liability, before and after LOE entry into force, like a judicial creation of the Civil Chamber of the Supreme Court when a plurality of building agents have contribuited to cause construction deffects and the judge can not discern which of them is the real liable or the share of liability that belong to each one.
