This article analyses the existence of a possible paradox in the transitional justice. On one side it demonstrates that although motivated by reasonable incentives, victims and perpetrators give their preferences regarding punishment and healing against a necessary condition of rationality: transitivity. Additionally shows arguments in favor of the transitivity of the preferences. in the application of the formal argument against the transitivity as in the argument in favor the authors retain the mental phenomenon of the preferences formation lying on the mind philosophy and moral philosophy.
