Resumen: La norma basica como fruto de un consenso politico – moral – social – economico de una sociedad, reune en su seno todas las posturas que se dan al interior de ella, producto de una expresion de la participacion y pluralidad, fundada en el respeto de la dignidad humana, en el trabajo y la solidaridad de las personas que la integran. Sin embargo, no hay en la Constitucion del 91 un contenido claro e inequivoco de los derechos colectivos que toda Constitucion garantista debe proteger, porque tiene un caracter reduccionista, positivista, como concesiones del Estado y no como derechos del cual son titulares los sujetos colectivos. Abstract: The basic rule as a result of a political consensus - moral - social - economic problems of society, it brings together all the positions that are inside of it, the product of an expression of participation and pluralism, based on respect of the human dignity, work and solidarity of people of coverage, however, there is not in the Constitution of 91 a clear and unequivocal collective rights of the Constitution guarantees that all must protect, because it has a reductionist, positivist, as concessions of the state and not as rights holders of which are the collective subjects.
