Resumen Se demuestra a traves de este ensayo que el “imperativo de la tolerancia” expuesto por el filosofo aleman Arthur Kaufmann en su libro “Filosofia del derecho”, es propio de los Estados liberales capitalistas que imponen la tolerancia represiva, es decir, aquella que se ajusta solo a los intereses de los dominantes, pues tiene un contenido mesianico imperialista que, ante la ejecucion de acciones injustas contra la humanidad para sostener y acrecentar sus niveles de vida desarrollados y su concentracion de riqueza, deben proponerse tratar de “evitar o hacer menos miserable” la vida de los seres humanos; pero en caso de no poderse se debe proseguir con la injusticia sin medir el grado de desgracia que pueda producirse. El “Imperativo de la Tolerancia” tiene su genesis en la “Asimetria Etica” del sistema capitalista, hoy dia mas aguda y voraz con las politicas neo – conservadores o neo – liberales, que imponen una politica criminal mundial encaminada a la represion social. En este sentido, el Derecho como instrumento de fuerza, tiene un “ser del deber ser” donde toda la nano-normatividad de un sistema juridico local, regional e inclusive mundial, van encaminados no a la proteccion de los derechos humanos, sino a la exaltacion de la concentracion de la propiedad y su riqueza – madre de todas las miserias -; sin embargo, ante el sufrimiento, la humanidad no se rinde, la tierra de los filosofos, Grecia y otros paises del mundo, se resisten y al igual que el autor de este ensayo se acogen al imperativo propuesto: “actua para erradicar totalmente la miseria humana”.
